In this document I (Gaitrie Parshadi) provide you with information about how my company (Vani Zorg BV) handles your personal data, which I will receive in the context of my work. Due to the sensitivity of this data, privacy is of paramount importance to me.

To whom does this privacy statement apply?

This privacy statement applies to all my clients. In addition, this privacy statement applies if you visit my website, are a former client, want to become a client or wanted to become a client but this has not happened or I act for your healthcare provider.





Your personal data

In order to be able to provide the care that suits your situation, I will talk to you. In this conversation I ask you several questions. These questions relate to your health situation, use of medication, care needs and wishes to the extent necessary for the indicated or desired care and your own options. In addition, other personal data may be requested, including: your name, address, date of birth, account number, telephone number and e-mail address.



If you are being treated, this information will be recorded in your medical file.


Permission

Your personal data may not just be processed by me, I need a legitimate basis for this. This often results from the treatment agreement or a legal obligation. Sometimes this is based on your explicit consent. You can withdraw your consent at any time. For minors up to the age of 12, I ask permission from a parent/guardian/legal representative. For minors aged 12 to 16, I request permission from both the minor and the parent/guardian/legal representative.

If you do not agree or withdraw your consent, I cannot serve you properly. Providing good care stands or falls with having access to all necessary and/or relevant information. In addition, I am obliged to keep a medical file in order to guarantee the quality of (future) care. If I have insufficient information to provide responsible care, I will inform you about this.


I will handle your data with care

I handle the information I receive from you with care. I have taken technical and organizational measures to prevent unauthorized persons from taking cognizance of this data.

As a healthcare provider, I have a duty of professional secrecy, on the basis of which nothing may be passed on to third parties. In addition, I do not transfer personal data to a country outside the European Economic Area (EEA). In exceptional cases, it may be necessary for other healthcare providers to quickly access your medical file, for example in the event of an emergency.

In order to comply with my accountability obligation, I keep registers of processing operations and possible data leaks.


How do I use the data received from you?

I use the data I receive from you to form a picture of your health situation and to provide you with the best possible care that you want or need. I will only pass on the personal data received from you to third parties in the context of the assignment you have given me to perform certain care tasks for you. I only pass on the data to these third parties insofar as you have given permission or they are directly involved in the treatment and they really need this data to provide the necessary or requested care.


Specifically, I can process your personal data in the following situations, among other things.


Commencement of the care Before the start of the care, you must state your BSN number. I have to check that on your ID. I do not make a copy or scan of it. I will also ask you for your file with your previous care provider.


Referral Sometimes it may be necessary to refer you to another specialist. I only provide the necessary personal data to this specialist. If you make an appointment with this specialist, this is seen as giving permission for the exchange of personal data.


PaymentI use your data to send your insurer or you an invoice for the treatment. This can also be done through a factoring company or administration office. The invoice contains your name and address details and a specification of the treatment. I keep these invoices for my debtor administration. If an invoice is not paid after several reminders, data can be shared with third parties for collection.


Health insurer If you are insured, I will exchange your personal data with the health insurer. I only exchange the necessary data. The health insurer can also request information from insured parties for a check. Depending on the type of research, I must provide the requested information. I will always put your privacy first.


Reporting incidents If something unexpectedly went wrong with the protection of your personal data (or I suspect that it did) and this may pose a high risk to your rights and freedoms, I will notify you as soon as possible the height. In some situations, an incident must be reported to the Dutch Data Protection Authority.


ProcessorIt may be necessary for data to be shared with third parties, such as an IT supplier or an administrative office. If this third party qualifies as a processor, I will conclude a processing agreement with this party so that your privacy is protected.


How long do I keep your data?

Your personal data will not be kept for longer than is necessary under applicable laws and regulations. On the basis of the WGBO, healthcare providers are obliged to keep medical files for 20 years from the time when the last change in the file took place, or for such longer as reasonably ensues from the care of a good care provider (or if this is in the interest belongs to someone else). When this period has expired, your data will be destroyed. In principle, your data will not be kept longer than necessary for data to which the WGBO does not apply, unless a different statutory retention period applies to this data.


What are your rights?

As a client, you determine which data I will or will not receive from you. I summarize the rights that you can also claim below. If you want to exercise one of your rights, I ask you to make a request in writing. You will find my contact details at the top of the regulations. I aim to respond to your request within four weeks.



Right of access and copy You have the right to take cognizance of the data in your file. You can view your file by appointment. Personal notes and data of third parties in the file are not subject to the right of access. In addition, you can always ask me for a copy of your personal data. I provide this copy once free of charge.

Right to correction If you believe that I have incorrectly processed certain information about you in my administration, you can request correction. You can also complete your client file. In addition, make sure that you report changes in your situation so that the data on the basis of which I provide care is correct.


Right to deletion If you no longer want me to keep certain data in my administration, you can request me to delete this data. I will comply with this request in most cases. In some cases, deletion is not possible. Attention must be paid to the interest of another person in retaining the data or to the legal regulations that oppose destruction.


Right to restriction I have indicated above how I use the data received from you. If at any time you want to limit this use, for example you do not want me to pass on certain data to a specific organization, you can let me know. I will comply with this request.


Source data If I receive personal information from you from third parties, I will inform you about the source from which I received this information.


Other rights You also have the right to information, restriction of data processing, right to object to data processing and the right to obtain your data in electronic form. In addition, you also have the right to request by whom and when certain information was made available to others via the electronic exchange system and when certain information was viewed or requested by others.

WebsiteIf you fill in the contact form on my website or send me an e-mail, the data you have sent will be stored for as long as the nature of the form or the content of your e-mail require for the complete answering and processing thereof.
